Employment rights solicitor Ben is part of Thompsons Solicitors’ Employment Matters Team and covers cases across the north west of England.

Based from Thompsons’ Liverpool office, Ben has more than 13 years experience as a solicitor and is responsible for representing trade union members at Employment Tribunal proceedings. Ben also provides legal advice on all aspects of employment law to trade union officials.

With a pragmatic and no-nonsense approach to negotiations, Ben always aims to achieve a swift and successful resolution for clients.

Ben is acutely aware that his clients have normally suffered a trauma and/or a major inconvenience at the hands of their employer and is focused on ensuring that no further emotional strain during the litigation process is caused.

Working for Thompsons is a “privilege” for Ben, who cites the firm’s proud history as part of the trade union and labour movement, its commitment to only ever working on behalf of injured parties, never bosses or insurers, and its compassionate and collegiate ethos.

Ben keeps busy outside of work, playing league tennis, practising yoga and, when possible, embarking on jungle expeditions and going skiing. Ben also enjoys spending time with his family and reading literature.

Ben has negotiated settlements in mass litigation in the shipbuilding, road haulage and public transport sectors arising out of the Employment Appeal Tribunal case of ‘Bear Scotland & Others’, which ruled that regular overtime should be included in the calculation of holiday pay.

One of Ben’s cases (Butt v Advel) was contested and proceeded to successful conclusion at the Employment Tribunal. Though the decision is not binding in other courts and tribunals in England, Wales and Scotland, it has been cited in holiday pay cases in those jurisdictions.

Ben’s former client said: “I could not have had better service anywhere! Ben Diaz was excellent on every occasion I had contact with him, he explained the processes to me and I therefore had great confidence in the advice that he gave me.”

Another of Ben’s former clients said: “My case was handled by Ben Diaz, who was very professional. He kept myself up to date with what was happening and was very easy to speak to and get along with. When I phoned and he wasn't available he always got back to me as soon as he was available. If he is typical of the staff at Thompsons I would have no hesitation in recommending you.”
