Accident at work

HGV driver story

We helped a Unite the union member secure £20,000 in compensation for injuries sustained in an accident caused by a pothole.

The HGV driver, employed by Eddie Stobart, tripped in the yard on site in Warrington and suffered a wrist fracture that required surgery. As a result, our client was unable to work for over a year and when he did return, he struggled to carry out routine tasks.

“The yard was a hazard – it was only a matter of time before someone injured themselves,” the Unite member said. “I was unlucky enough to be that person.”

The injury impacted almost all facets of his life and he was later diagnosed with rheumatoid arthritis.

After his fall, he turned to his union, Unite, and contacted Thompsons Solicitors to make an accident at work compensation claim.

He continued: “The pain is still there – whether I’m doing D.I.Y or reversing my car. Even carrying shopping has become almost impossible because of the lack of strength in my wrist.

“I’m just glad of the support from Unite and Thompsons. From the outset they gave me confidence to pursue this claim and kept me informed throughout the case. They have been fantastic.”

We’re glad that alongside Unite we were able to get him the compensation he deserves – it just goes to show how important trade union membership really is.

Rachel Leach, lawyer at Thompsons Solicitors

Rachel Leach of Thompsons Solicitors said: “It is an employers’ duty to ensure there are no health and safety risks in the workplace. Unfortunately, rather than making a simple fix and filling in the pothole, the employer thought they could get away with ignoring the risks and our client paid the price.

“We’re glad that alongside Unite we were able to get him the compensation he deserves – it just goes to show how important trade union membership really is.”
