The government has confirmed that it intends to stick to the original implementation timetable for the Employment Rights Act 2025 (ERA 2025), as set out in the roadmap published on 1 July 2025.
In response to a written question from Lord Hunt of Wirral, who had asked when a revised implementation timetable would be published. Baroness Lloyd of Effra confirmed that the government “remains committed” to the original roadmap. She added that further updates and support for employers and workers would be provided in early 2026.
The Employment Rights Act 2025 (Commencement No 1 and Transitional and Saving Provisions) Regulations 2026 (SI 2026/3) have already been made. These bring into force industrial action changes from 18 February 2026 and day one rights in relation to family leave and SSP in April 2026.
Consultations have also been launched on the following:
- Enhanced dismissal protections for pregnant women and new mothers – closed 15 January 2026
- Leave for bereavement, including pregnancy loss– closed 15 January 2026
- Trade union right of access - closed 18 December 2025
- Duty to inform workers of right to join a union- closed 18 December 2025
- Draft code of practice on electronic and workplace balloting for statutory union ballots – closes 28 January 2026
- Consultation on the fair pay agreement process in adult social care – closed 16 January 2026
