Serious injury case

Brain injury client

When our client was knocked off his motorbike by a car in a hit-and-run incident, he suffered a severe brain injury that left him wheelchair and nurse dependent.

He was riding his Harley Davidson in October 2016 when a car hit him from behind before fleeing the scene. Police made an arrest, but a lack of forensics prevented prosecution.

After securing a £45,000 interim payment and rehabilitation package from the Motor Insurers’ Bureau to support our client’s short-term care needs, our specialist injury lawyers carefully began building a body of evidence that connected the car and driver to the accident, including by interviewing the police and instructing video analysis of CCTV footage at the scene.

"With the support of our client’s family, and by drawing from the decades of experience and skills we have at Thompsons in these cases, we were able to secure compensation that I’m pleased to say is helping him live a fulfilling life."

Karl de Loyde, of Thompsons Solicitors

Our aim was to improve our client’s quality of life by securing a more substantial package of compensation and support for him from the driver’s insurance company, which had initially denied any liability.

Eventually, the insurer admitted full liability and, alongside Unite the union, we secured almost £6 million in compensation.

The money has enabled our client to buy a home specially adapted to his needs, where his family and friends can visit and spend quality time with him, and he has a team of professional staff on hand to provide comprehensive rehabilitation and one to one, person-centered care and support.

His daughter said: “Five years ago, the unexpected happened and Karl, our solicitor, was there right from the start to guide us through the process and help us look to create a better future and outcome for my dad.

“Through securing interim payments, and then ultimately, the case settlement, we had hope. The payments secured helped to fund much needed private therapy, such as occupational health, physiotherapy and rehab assistance, which were pivotal to the high level of recovery he has made today.

“Because of what Karl achieved, my dad is now living in a home of his own, has gained back a lot of his independence and physical abilities and he is living a life – that five years ago – seemed only something we could have dreamed of.”

Karl de Loyde, a serious injury specialist and partner at Thompsons Solicitors, added: “This wasn’t a straightforward case - the driver had left the scene of the accident and without evidence connecting him and the vehicle to our client’s injuries, we knew we couldn’t secure the level of compensation he needed to meet his needs.

“But, with the support of our client’s family, and by drawing from the decades of experience and skills we have at Thompsons in these cases, we were able to secure compensation that I’m pleased to say is helping him live a fulfilling life. It’s the least he and his family deserve.”
