Following an independent review into the right to request flexible working, the Government has agreed to extend the right to parents with children up to the age of 16.
Regulation 8(1) of TUPE 1981 (now regulation 7 (1) of TUPE 2006) states that it is unfair to dismiss an employee before or after a transfer if the reason (or main reason) for the dismissal is connected with the transfer.
