Government research published last week has found that more than half of successful tribunal claimants do not receive their award in full, often because employers simply refuse to pay up.
Once an employee has established facts from which a tribunal could conclude that there had been discrimination then the employer has to show that they did not discriminate against them.
The Equality Act states that employers cannot impose a provision, criterion or practice (PCP) which discriminates against a worker on the basis of their sex, unless they can justify it.
