As part of another package of measures in its so-called “red-tape” challenge, the government last week issued a call for evidence to look at the current whistleblowing laws.
The law says there is a genuine redundancy situation when an employee is dismissed because their employer decided to reduce the size of the workforce to do “work of a particular kind”.
Before dismissing someone for misconduct, employers have to have a genuine belief that the employee is guilty, based on reasonable grounds and following a reasonable investigation.
