The latest statistics published by the government’s Tribunal Service reveal that the number of employment claims received in the last quarter increased by more than a third.
Under the Transfer of Undertakings (Protection of Employment) Regulations 2006 (TUPE), employers can be required to pay “appropriate compensation” for failing to inform and consult their employees in advance of a transfer.
Until recently, the law required employers who propose to make 100 or more employees redundant to consult with them at least 90 days (now 45) before the first dismissal takes effect.
