In its response to the government’s second consultation on a UK Bill of Rights, Thompsons has argued that a new UK bill should add to current protections, not detract from them.
Under section 123 of the Employment Rights Act 1996, tribunals can make awards of compensation for loss of earnings following a dismissal “insofar as that loss is attributable to action taken by the employer.”
Section 98(4) of the Employment Rights Act (ERA) 1996 states that, when deciding if a dismissal is fair, tribunals have to consider whether the employer acted reasonably or not.
