The Tribunals Service has just published its annual report for the year 2009 to 2010 which shows an increase of 56% in employment claims over the previous year.
The House of Lords held in Johnson v Unisys Ltd that employees could not claim common law damages for breach of an implied term of trust and confidence connected to a dismissal.
Under the statutory rules governing dispute resolution (repealed in April 2009), tribunals could increase an award if either side failed to comply with them.
