An analysis of trade union membership by the Department of Trade and Industry (DTI) has found that the rate of union density has fallen by just under one per cent since 2006 to 28.4 per cent.

In the vast majority of cases involving a sale of shares, the Transfer of Undertakings (Protection of Employment) Regulations 1981 (TUPE) do not apply.

Transfer Reason

Regulation 8(2) of the Transfer of Undertakings (Protection of Employment) Regulations 1981 (TUPE) allows both transferors and transferees to dismiss an employee if they can show it was for an economic, technical or organisational (ETO) reason entailing changes in the workforce.
