Following an informal information gathering exercise last year, the government recently announced a consultation to look at whether employers are abusing zero hours contracts.
It is already established in law that If a tribunal agrees to an application for interim relief it can order the employer to “continue” the employee’s contract until the full hearing.
The National Minimum Wage (NMW) legislation states that workers who “sleep over” are only entitled to be paid for the hours that they actually work.
