The Maritime Labour Convention 2006, which was ratified earlier this month by the UK, came into force this week.
Following the decision in Johnson v Unisys, employees cannot bring claims for damages for personal injury following dismissal if the dismissal breached the implied term of trust and confidence, unless the injury was unrelated to the dismissal.
The purpose of the Transfer of Undertakings (Protection of Employment) legislation (TUPE) is to safeguard the terms and conditions of employees after a transfer.
