The House of Lords have voted in favour of an amendment to the Enterprise and Regulatory Reform Bill which removes civil liability for breaches of health and safety regulations.
In order to enforce an employer’s redundancy policy, the employee has to show that it constitutes a term of their contract.
Section 139 of the Employment Rights Act 1996 sets out the specific circumstances in which a redundancy situation can arise.
