In May 2012, the Home Secretary Theresa May announced a review of the public sector equality duty. This brought forward a review of the Equality Act (Specific Duties) Regulations 2011, which is now combined with a review of the general duty.
When investigating allegations of serious misconduct, employers must hold a genuine belief in the person’s guilt based on reasonable grounds and follow a reasonable investigation.
The Employment Rights Act 1996 states that an employee is deemed to have been dismissed by reason of redundancy if the dismissal is “wholly or mainly” attributable to the redundancy.
